29 CFR 1926.451(e)(9)(iv): Cross braces on tubular welded frame scaffolds were used as a means of access or egress.  On or about August 5, 2015, employees were using the cross braces on a scaffold to gain access to upper levels of the scaffold. This condition exposed employees to fall hazards exceeding 10 feet.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  On or about August 5, 2015, employees working on a scaffold were not protected from falls by the use of personal fall arrest systems or guardrail system.  This condition exposed employees to falls exceeding 10 feet.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights shall bear on base plates and mud sills or other adequate firm foundation.  On August 5, 2015, and times prior to, employee were working on a scaffold that did not have base plates. This condition exposed employees to falls greater than 10 feet.

29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coatings, herbicides, or insecticides, or in other operations where contaminants may be harmful to employees. Such facilities were not in near proximity to the worksite and were not equipped as to enable employees to remove such substances.  On or about August 5, 2015, the employer did not provide adequate washing facilities for employees engaged in the application of paints and coating. This condition exposed employees to adverse health hazards.  Bernal Plastering was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.51(f)(1), which was contained in OSHA inspection number 1053183, citation number 1, item number 1 and was affirmed as a final order on May 21, 2015, with respect to a workplace located at 2625 N Mesa St, El Paso TX 79902.
