29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  (a) Jobsite - On or about August 3 , 2015 employees for Jose Gutierrez removed a damaged section of roofing material creating a hole approximately 12' X 12' exposing employees to a fall hazard.  The hole was not guarded, covered, and no fall arrest system was worn during the replacement of the roof material to prevent employees from falling through.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.    (a) Jobsite - On or about August 3, 2015 the employer had not provided training to an employee operating a construction ariel boom lift industrial fork truck.  The employee was using the ariel boom lift to lift roofing material onto the top of the roof.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    (a) Jobsite -  On or about August 3, 2015 the employees used a Werner aluminum telescoping portable ladder to gain access to the canopy above the loading docks and another Werner aluminum ladder to gain access from canopy to the roof. The ladders did not extend 3 feet past each landing and were not secured to prevent employee from falling.
