29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  An employee operating a JLG powered industrial truck at the job site to haul construction materials was exposed to struck-by hazards.  The powered industrial truck operator had not received training that demonstrated competency to operate the equipment safely.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) At the location of 12830 Johnson Drive in Shawnee, KS, employees engaged in structural framing were exposed to fall hazards of approximately 21 feet from the third floor to the ground below.  The employees were exposed in that a fall protection system was not in place to keep them from falling.  (b) At the location of 12830 Johnson Drive in Shawnee, KS, employees engaged in structural framing were exposed to fall hazards of approximately 11 feet from the top plate on the third floor to the wooden floor below.  The employees were exposed in that a fall protection system was not in place to keep them from falling.  Michael Noeller Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1047410, citation number 1, item number 1 and was affirmed as a final order on June 23, 2015, with respect to a workplace located at 1106 W. 47th Street, Kansas City, Missouri.
