29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    Construction site: On or about August 6, 2015 and at times prior thereto, one employee was observed working form an aerial lift without any form of fall protection. This condition exposed the employee to a fall greater than 10-feet to the ground below.

29 CFR 1926.454(c)(3): Inadequacies in an employee's work involving scaffolds indicates that the employee has not retained the requisite proficiency.    Construction site: On or about August 6, 2015 and at times prior thereto, the employee's lack of knowledge and/or use of fall protection indicate that the employee has not retained the requisite proficiency to enable him to recognize the hazards of falling. This condition exposed the employee to a fall greater than 10-feet to the ground below.
