OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushing injuries while working in a temporary tensioned-membrane structure during inclement weather:  a. Site - Employees were not protected from struck by and crushing injuries where the employer did not erect an adequately secured temporary tensioned-membrane structure (big top circus tent) and did not erect the structure at the Lancaster, NH fairgrounds in accordance with the professional engineer's design and diagram.     On or about August 3, 2015, employees working inside the big top circus tent were exposed to struck by and crushing injuries when the big top circus tent collapsed during a hazardous weather event.  Prior to this weather event there were 7 warnings broadcasted by the National Weather Service which included hazardous weather outlooks, a severe thunderstorm watch, and severe thunderstorm warnings that anticipated damaging winds in access of 60 mph in this area.

Trailer- An employee operating an MQ Whisperwatt 70 kva generator was not protected from electric shock and arc flash injuries where openings in a box mounted to the top of the generator were not closed. Conductors coming out of the top of the left hand generator enter a box and the conductors pass through conduit from the box to a double throw safety switch. The conduit is not connected to the box on the top of the generator. The conduit and box come together next to an opening in the enclosure around the generators exposing the electrical equipment to rain.
