29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Worksite, Front of home, 316 Bellmore Rd. East Meadow NY - Employees were installing vinyl siding on a residential home while working on the roof of a portico.  The employees were not protected from falling approximately 15ft to the ground below; on or about 8/8/15.    b)  Worksite, Back of home NY, 316 Bellmore Rd. East Meadow NY - Employee was installing vinyl siding on the chimney of a residential home while working on the roof.  The employee was not protected from falling approximately 25ft to the ground below; on or about 8/8/15.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:      a) Worksite, 316 Bellmore Rd. East Meadow NY - Employees installing siding on a two story residential home.  The employees were accessing the work area by using an extension ladder that was set up approximately 1ft above the landing; on or about 8/8/15.     Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
