OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer failed to ensure that the Ottawa Yard Truck was maintained in a safe working condition: (a) The brake pedal and the gas pedal on the Ottawa Yard Truck sticks and the tires would lock up while employees operated the yard truck. Among other methods, one feasible and acceptable method to correct this hazard is to implement an effective inspection, maintenance and repair program as outlined in the operators manual and the 29 CFR 1910.178 OSHA standard.

(b) A Crown Electric Forklift (S/N 9A140562) was not taken out of service when the brakes began to deteriorate.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. (a) The forklifts were not inspected on a daily basis.
