29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a) Nunez Glazing Evolution, LLC on or about August 13, 2015, at the address of 7445 St. Rt. 109 Delta, OH: The employer failed to ensure employees working from a Skyjack SJ7125 scissor lift were adequately protected from falls.  At least two employees were not tied off to the platform and were observed standing on atop the midrail, effectively bypassing all fall protection measures.  The employees working in this condition were exposed to an approximate 12 ft. fall to the ground below.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  (a)  Nunez Glazing Evolution, LLC on or about August 13, 2015, at the address of 7445 St. Rt. 109 Delta, OH: The employer failed to ensure employees working from a Skyjack SJ7125 scissor lift were trained to recognize and avoid hazards associated with this type of scaffold, such as, but not limited to fall hazards.
