29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:      a) Garage - On or about August 13, 2015 and at times prior thereto, employees were performing framing work on the second floor near a window opening that did not have a top rail for fall protection, exposing them to falls of approximately 10'.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:   a) Garage Roof - On or about August 13, 2015 and at times prior thereto, employees were performing framing work on the second floor near a window opening that did not have a top rail for fall protection, exposing them to falls of approximately 10'.  The employer did not have written certification that verified employees were trained in fall hazards and how to protect themselves from falls.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):      a) Garage Roof - On or about August 13, 2015 and at times prior thereto, employees were performing framing work on the second floor of the garage and using the window and 12 on 12 sloped roof as access and egress without the use of fall protection, exposing them to falls of approximately 10'.      The Home Evolution Roofing & Siding was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 991039, citation number 2, item number 1 and was affirmed as a final order on 9-11-2014, with respect to a workplace located at 1249 Cullen Ave, Schenectady, NY 12309.
