29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. (a) Back of Building - On or about August 12, 2015 two employees were exposed to a falling object hazard due to employees passing tools and lumber directly overhead. Two employees were elevated on the forks of a Bobcat T190 directly above other employees.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use. (a) Back of Building - On or about August 12, 2015 two employees were exposed to fall hazard and struck-by hazard while standing on wooden boards supported by the forks of a Bobcat T190 (serial no. 531614484). Employees were elevated 5 feet above the ground by powered industrial truck. The operator's manual prohibits the bobcat to be used as a man lift or elevating device for personnel.

29 CFR 1926.602(c)(1)(vi): All industrial trucks in use shall meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. (a) Back of Building - On or about August 12, 2015 two employees were exposed to a struck by hazard in while walking directly under the forks of a Bobcat T190 (serial no. 531614484). (b) Back of Building On or about August 12, 2015 four employees were exposed to a struck by hazard when the operator dismounted a Bobcat T190 (serial no. 531614484). The forks or lift arms were not lowered to ground. Two employees walked under the forks of the Bobcat. Two other employees were elevated the forks of the Bobcat.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. (a) Construction Site - On or about August 12, 2015 the employer did not train each employee on how recognize, prevent and minimize exposure to unsafe working conditions. Employees rode on the elevated forks of a Bobcat, employees walked under the forks of a Bobcat, employee left the Bobcat elevated and unattended and employees did not wear hardhats while exposed to overhead hazards.
