29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights is no more than 1 inch wide: a) On or about August 4, 2015, rear of building/north-side; the working platform, on the scaffold system, was not fully planked exposing employees to a 40 foot fall to ground level; while conducting masonry work. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: a) On August 4, 2015 and at times prior thereto: rear area/North-side of the building: employees were working off a scaffold system without fall protection to protect them from falling an estimated 40 feet to ground level; while conducting masonry work. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. Crossbraces were used as a means of access: a) On or about August 4, 2015; rear of building north-side; employees were accessing the work platform by using the outside frame of the scaffold system. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
