29 CFR 1926.1101(k)(9)(i): The employer did not institute a training program for all employees who are likely to be exposed in excess of a PEL and for all employees who perform Class I through Class IV asbestos operations, and did not ensure their participation in the program: a) On or about June 29, 2015, and at times prior, employees were exposed to asbestos because they were not provided with adequate training for Class III and Class IV asbestos operations. Several employees regularly worked around or contacted asbestos containing materials (ACM) or potentially asbestos containing materials (PACM) such as drywall surfacing materials in order to perform renovation work.

29 CFR 1926.1101(k)(3)(ii): Before work under this standard was performed, the employer did not inform employees of the location and quantity of ACM and/or PACM present in the area and the precautions to be taken to insure that airborne asbestos is confined to the area: a) On or about June 29, 2015, and at times prior, employees performing renovation work were exposed to asbestos because they were not informed of the presence, location, and quantity of asbestos containing materials (ACM) or potentially asbestos containing materials (PACM) located in drywall surfacing and other building materials.
