If such hazards are present, or likely to be present, the employer shall:    29 CFR 1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;    a.  On the site where employees were performing logging operations, the employer did not identify job tasks and the personnel protective needed to perform that job task thereby exposing employees to a struck-by hazard.

For each vehicle or machine (equipped with ROPS/FOPS or overhead guards), including any vehicle or machine provided by an employee, the employer shall assure:    29 CFR 1910.266(d)(3)(i): That a seat belt is provided for each vehicle or machine operator;    a.  In the woods where logs were pulled out during a logging operation, the John Deere 640 skidder was not equipped with a seat belt thereby exposing employees to a struck-by hazard.

Each machine operator and maintenance employee shall comply with the operating and maintenance instructions.    a.  On the site where logging operations were performed, the employer did not have operating and maintenance records available on site or in the office thereby not enabling employees the procedures for inspecting equipment and checking the operating systems.
