OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazards of being stuck-by or caught-in- between:     On 9/1/2015, employees working at Calverts Auto Express and Tire located at 1935 E. Terra Lane, O Fallon MO were working with eight automotive lifts in their repair facility. None of lifts were inspected per the Challenger Lifts Installation, Operation & Maintenance Manual or the 2008 American National Standards Institute Standard for Automotive Lifts, Safety Requirements of Operation, Inspection and Maintenance (ANSI/ALI ALIOM:2008).  Calverts Auto Express and Tire had the following defective lifts at the location:      a) Challenger Lift #3, Model E10, Serial # 120700000081601, serial # A5H204; the lift had a hydraulic leak.    b) Challenger Lift #4, Model E10, Serial # 120700000081594; the lift had a hydraulic leak and damaged foot pad rubber insert.      One method of abatement is to have a qualified inspector perform inspections required by ANSI/ALI ALIOM: 2008, paragraphs 5.6.1 through 5.6.6.5.  The issues with automotive lifts   #3 & #4 may be abated by having a qualified inspector perform inspections as required by the ANSI/ALI ALIOM: 2008, paragraphs 5.6.3.1 and 5.6.2.17 and making the necessary repair per the manufactures maintenance instruction manual.      DISCLAIMER:       a) The employer is not limited to the abatement method(s) suggested by OSHA.    b) The employer is responsible for selecting and implementing an effective abatement method.
