29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1):  a) On or about August 26, 2015 and times prior employees were exposed to health issues when working on the repair of ceiling material containing asbestos. The employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing materials prior to instructing employees to work in these areas.  Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet Letter").

29 CFR 1926.1101(k)(3)(ii): Before work under this standard is performed employers of employees who will perform such work shall inform the following persons of the location and quantity of ACM and/or PACM present in the area and the precautions to be taken to insure that airborne asbestos is confined to the area.  a) On or about August 26, 2015 and times prior employees were exposed to health issues when working on the repair of ceiling material containing asbestos. The employer did not inform employees of the location and quantity of asbestos containing material and/or presumed asbestos containing materials prior to instructing employees to work in these areas. The employer did not advise employees the precautions to be taken when working in areas where asbestos containing materials were present.  Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet Letter").

29 CFR 1926.1101(k)(9)(i): The employer did not ensure participation in the asbestos training program by each employee who was likely to be exposed to asbestos in excess of the permissible exposure limit (PEL), or for each employee engaged in Class I through Class IV asbestos operations:  a) On or about August 26, 2015 and times prior employees were exposed to health issues when working on the repair of ceiling material containing asbestos. The employer did not provide employees with asbestos training where the repair of ceiling material covered with asbestos texturing was being performed.
