29 CFR 1910.23(a)(8): Every floor hole into which persons can accidentally walk were not guarded:  Penthouse stairway access - employees were accessing fixed industrial stairs leading to the penthouse by stepping on and/or over the hole between the portable work platform and stairs. Employees were exposed to fall-through hazards.  There is no abatement certification or documentation required for this item.

29 CFR 1910.23(e)(3)(iv): The anchoring of posts and framing of members for railings of all types shall be of such construction that the completed structure shall be capable of withstanding a load of at least 200 pounds applied in any direction at any point on the top rail.  Penthouse: employees walking on the platform located approximately 50 feet above the adjacent ground level were exposed to fall hazards where the top and intermediate rails of the southwest standard guardrail were not structurally completed and continuous due to being cut and/or other damage.  There is no abatement certification or documentation required for this item.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein:  Asphalt additives containers: outdoor plastic tanks containing Redicote and/or Rediset asphalt additives were not labeled to identify the chemical and its hazards. Employees were transferring the chemical from storage tanks to a process tank.  There is no abatement certification or documentation required for this item.

29 CFR 1910.303(b)(7):  Electrical equipment was not installed in a neat and workmanlike manner:  West, screen decks: electrical installation of cables powering motors was not completed in a neat and workmanlike manner where the overhead power cables were suspended horizontally and supported vertically by an unsecured aluminum tray in the walkway.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
