29 CFR 1926.1101(k)(2)(ii)(B): The building owner and/or facility owner did not notify employees of the owner who will work in or adjacent to areas containing asbestos containing material or presumed asbestos containing material of the presence, location and quantity: a) On or about April 30, 2015, and at times prior, employees were exposed to asbestos because they were not informed of the presence, location and quantity of asbestos in the buildings they worked in. Several maintenance employees regularly conducted Class IV asbestos activities including painting over asbestos containing materials (ACM) or potentially asbestos containing materials (PACM) such as surfacing materials for drywall and ceilings.

29 CFR 1926.1101(k)(9)(i): The employer did not institute a training program for all employees who are likely to be exposed in excess of a PEL and for all employees who perform Class I through Class IV asbestos operations, and did not ensure their participation in the program: a) On or about April 30, 2015, and at times prior, employees were exposed to asbestos because they were not provided with adequate training for Class III or IV asbestos operations. Several maintenance employees regularly conducted Class III or IV asbestos activities including painting over asbestos containing materials (ACM) or potentially asbestos containing materials (PACM) such as surfacing materials for drywall and ceilings.
