29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. a. The employees were painting the underside of the canopy, the employer did not train the employee on the hazards of the chemical such as flammability, thereby exposing the employee to a chemical hazard.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a. The employee was painting the underside of the guard checkpoint canopy from an aerial lift basket without fall protection, thereby exposing the employee to a 10-15 foot fall hazard.

29 CFR 1926.454(a)(3): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: The proper use of the scaffold, and the proper handling of materials on the scaffold; a. The employee was operating an aerial lift without receiving training by the employer on the safe operation of the lift prior to being allowed to use it, thereby exposing the employee to a fall hazard of 10-15 feet.
