29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:      a) On or about 9/10/15, on the Mavis Discount Tire Store construction site at 2593 Sheridan Dr., Tonawanda, NY:  An employee was exposed to a fall of approx. 14 ft. from the north end of a scissors lift while installing EIFS to a cornice.  The mid-chain on the north end of the scissors lift was not fastened.      NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:      a) On or about 9/10/15, on the Mavis Discount Tire Store construction site at 2593 Sheridan Dr., Tonawanda, NY:  An employee was exposed to a fall of 16 ft. from the building roof on the north side of the building, while installing EIFS to a cornice.  No fall protection system was utilized.      NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a) On or about 9/10/15, on the Mavis Discount Tire Store construction site at 2593 Sheridan Dr., Tonawanda, NY:  Employee  engaged in construction work near the roof edge was not trained to recognize potential hazards on this type of jobsite,  including but not limited to falls from roofs &  ladders,  and electrical hazards. The employee also was not trained in the applicable OSHA regulations to control or eliminate these hazards.   ABATEMENT CERTIFICATION REQUIRED
