29 CFR 1910.134 (c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program.    a) Carmedix - The employer required employees performing spray painting and detailing to wear 3M 3600 half-mask dual cartridge respirators to protect the employees from spray paint vapors . A written respiratory protection program was not established and implemented.

29 CFR 1910.134(f)(2): The employer did not ensure that employees using a tight-fitting facepiece respirator were fit tested prior to the initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.    a) Carmedix Inc.  -  The employer required employees performing spray painting and detailing to wear 3M 3600 half-mask dual cartridge type respirators to protect the employees from spray paint vapors. The employees were not fit tested prior to initial use.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:     a) Carmedix Inc. - The employer did not implement at the workplace a written hazard communication program in accordance with 29 CFR 1910.1200 that describes at least the following:    1) Requirement for labeling of containers of hazardous chemicals:    2) Safety data sheet(s) availability;    3) Training of employees;    4) A complete list of hazardous chemicals known to be in the workplace;    5) Methods to inform employees of the hazards of non-routine tasks; and,    6) Methods to inform other employer(s) of material safety data sheets availability; the labeling system and any precautionary measures to protect employees.    The employees who conduct spray painting operations were exposed to hazardous chemicals, including European Clear Activator Medium ( n-butyl acetate, xylene, 1,6 hexamethylene diisocyanate,  isophorone diisocyanate homopolymer and isophorone diisocyanate), European Clear Activator Slow (n-butyl acetate, xylene, methyl n-amyl ketone, and hexamethylene diisocyanate), Key European Clear (isobutanol, ethylbenzene and xylene), Autoclear PC Clearcoat  (n-butyl acetate, ethylbenzene and xylene), Colorbuild Plus Black (limestone, n-butyl acetate, ethylbenzene and xylene), Colorbuild Plus White (limestone, n-butyl acetate, ethylbenzene and xylene) and Autowave MM 00 (2-butoxyethanol).
