29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  (a) Winston Balmaceda dba Winston Construction on or about September 16, 2015, at the address of 4 Lake St. Toledo, OH: The employer did not have a plan or program to identify jobsite hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the chance of employee injury and/or illness.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a)  Winston Balmaceda dba Winston Construction on or about September 16, 2015, at the address of 4 Lake St. Toledo, OH: The employer failed to ensure employees were protected from falls while installing new roofing material to a residential structure.  Employees working in this condition were exposed up to a 15 ft. fall to the ground below.
