29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift.  a) For the trench excavated approximately 70 feet from south to north on the back yard of the residential site, the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and as needed throughout the shift.  Employees were working to install a sewer line in an excavation at a depth ranging from 6.8 to 9.0 feet.  Employees did not have the protection of sloping, benching and/or engineering controls such as a trench box throughout the sewer installation.  Inspections were not completed for the potential cave-in hazards on the site.   b) For the trench excavated approximately 8 feet from east to west on the back yard of the residential site, the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and as needed throughout the shift.  Employees were working to install a sewer line in a trench at a depth ranging from 9.7 to 10.4 feet.  Employees did not have the protection of sloping, benching and/or engineering controls such as a trench box throughout the sewer installation.   Inspections were not completed for the potential cave-in hazards on the site.   Abatement certification AND documentation are required for this item.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  a) The employer did not provide a ladder for a portion of trench work for the sewer replacement. Employees were working to install a sewer line in a trench at a depth ranging from 6.8 to 9.0 feet.  Employees utilized a 3 foot deep bench inside of the trench to provide entry and egress from the work location.   The Foreman for the site was overseeing work inside of the trench.  Abatement certification is required for this item.

Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  a) On the west side of a trench excavated approximately 70 feet from south to north on the back yard of the residential site, the employer did not protect each worker by locating spoil piles at least 2 feet edge of a trench with a depth ranging from 6.8 to 9.0 feet.  Employees were working to install a sewer line in the trench.      Abatement certification AND documentation are required for this item.

29 CFR 1926.652(c): Designs of support systems, shield systems, and other protective systems was not selected and constructed by the employer or his designee and was not in accordance with the requirements of paragraph (c)(1); or, in the alternative, paragraph (c)(2); or, in the alternative, paragraph (c)(3); or, in the alternative, paragraph (c)(4) as follows:  a) The employer did not protect each worker in its trenches and excavations by properly designing wood shoring in that 3/4" inch wide 4' x 8' plywood was substituted for uprights, and three 2" x 4"s nailed together were used as cross braces.  Wood materials utilized in the wood shoring were not in compliance with OSHA Subpart P Appendix C Table C-1.1 Timber Trench Shoring - Minimum Timber Requirements for a trench depth of 5 to 10 feet.    Abatement certification and documentation is required for this item.
