Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to engulfment hazards:        (a)   DNJ Farms, Inc. at 25101 County Road 7, Merino, CO 80741:  On and before September 10, 2015 the employer did not develop and implement a written permit space entry program when employees entered permit-required confined spaces, in that employees entered grain bins that contained up to 40,000 bushels of either wheat, corn, or sunflowers.  Employees accessed the top hatch of the bins, climbed inside, and applied chemicals while walking along the top of the grain.  This condition exposed employees to engulfment hazards.          Abatement Note:  The requirements applicable to agricultural work under this section are identical to those set forth at 29 CFR 1910.146 of this chapter.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:        (a)  DNJ Farms, Inc. at 25101 County Road 7, Merino, CO 80741:  On and before September 10, 2015 fixed ladders that are attached to the sides of grain bins at the north location did not have cages installed around the ladders.  The ladders were approximately 30 feet in length.  This condition exposed employees that climb the fixed ladders to fall hazards of approximately 30 feet.      Abatement Note:  The requirements applicable to agricultural work under this section are identical to those set forth at 29 CFR 1910.27 of this chapter.

29 CFR 1910.1200(h)(1):  The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area:      (a)   DNJ Farms, Inc. at 25101 County Road 7, Merino, CO 80741:  On and before September 10, 2015 the employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area, such as but not limited to the following chemicals:      1)     Max-Kill-Dusta-Cide 6  2)     Weevil-Cide      Abatement Note:  Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals.  Chemical-specific information must always be available through labels and safety data sheets.
