29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.    a.  On or about September 24, 2015, at the construction site located at 6156 CR 68, Millersburg, Ohio, employees were performing roofing work on a new chicken barn with a pitch of approximately 4 in 12 and approximately 11 feet in height with no fall protection, thereby exposing the employees to a fall hazard.  An employee fell approximately 11 feet after proceeding from the roof onto an adjacent elevated material lifting platform and then was struck in the head by the falling platform resulting in immediate death.     b.  On or about September 30, 2015, at the construction site located at 6156 CR 68, Millersburg, Ohio, employees were performing roofing work on a new chicken barn with a pitch of approximately 4 in 12 and approximately 11 feet in height with no fall protection, thereby exposing the employees to a fall hazard.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced.    a.  On or about September 24, 2015, at the construction site located at 6156 CR 68, Millersburg, Ohio, without the manufacturer's written approval, employees utilized a Gehl RS6-42, model # 804616, serial # 27359, all-terrain forklift with an addition of an approximately twenty feet long, four feet wide, custom fabricated material lifting platform, serial # 15549,  that was not secured to the tines or lifting carriage of the machine, thereby exposing the employees to a struck-by hazard. An employee fell approximately 11 feet after proceeding from the roof onto an adjacent elevated material lifting platform and then was struck in the head by the falling platform resulting in immediate death.     b. 29 CFR 1904.39(a)(1): Basic Requirement.  Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor.    a.  The employer did not report a fatality that occurred on or about September 24, 2015 to OSHA.
