The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  a.  At the work site, an employee who worked in the bay where sand was loaded and unloaded was required to wear a tight-fitting half-face respirator in the bay.  The employer had not ensured the employee had been medically cleared to wear the respirator prior to allowing the employee to use it.

The training must be comprehensive, understandable, and recur annually, and more often if necessary. This paragraph also requires the employer to provide the basic information on respirators in Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so.  29 CFR 1910.134(k)(1)(i): Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator;  a.  At the work site, two employees who worked in the bays where sand was unloaded were required by the employer to wear a tight-fitting half-face respirator, one of which was observed visibly soiled and laying on a counter during the employee's shift. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.    a.  At the work site located at 42722 State Route 7, Hannibal, Ohio,  employees who processed sand on an inclined conveyor in the casting house area were exposed to an ingoing nip point from a guide on the conveyor belt frame, located approximately sixty-three (63) inches above the floor.  The employer had not adequately guarded the ingoing nip point.

29 CFR 1910.1000(c): Table Z-3. An employee's exposure to any substance listed in Table Z-3, in any 8-hour work shift of a 40-hour work week, shall not exceed the 8-hour time weighted average limit given for that substance in the table.    a.  On November 5, 2015, an employee performing the required duties as loader in the sand storage bay was over-exposed to respirable crystalline quartz silica at an 8 hour time weighted average of 47.31 milligrams of respirable dust per cubic meter of air.  This exposure is approximately 190 times the calculated permissible exposure limit of 0.250 milligrams of respirable dust per cubic meter of air.  The exposure was derived from samples collected over a 461 minute period.  Zero exposure was assumed for the unsampled period of 19 minutes.    b.  On November 5, 2015, an employee performing the required duties as loader in the sand storage bay was over-exposed to respirable crystalline quartz silica at an 8 hour time weighted average of 56.27 milligrams of respirable dust per cubic meter of air.  This exposure is approximately 226 times the calculated permissible exposure limit of 0.250 milligrams of respirable dust per cubic meter of air.  The exposure was derived from samples collected over a 461 minute period.  Zero exposure was assumed for the unsampled period of 19 minutes.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):    a.  On November 5, 2015, an employee performing the required duties as a loader in the casting area sand storage bay was overexposed to respirable crystalline quartz silica.    b.  On November 5, 2015, a second employee performing the required duties as a loader in the casting area sand storage bay was over-exposed to respirable crystalline quartz silica.    Recommended Abatement Action:    Step 1:  Employees shall be medically cleared and retrained on the use, cleaning and storage of their respirators.  Respirators will be worn until feasible engineering and/or administrative controls can be implemented or whenever such controls fail to reduce employee exposure to within permissible exposure limits.    Step 2:  Submit to the Area Director a written, detailed plan of abatement outlining a schedule for the implementation of engineering and/or administrative measures to control employee exposure to hazardous substances as referenced in this citation.  This plan shall include, at the minimum, target dates for the following actions which must be consistent with the abatement dates required by this citation:    1.  Evaluation of engineering/administrative control options;  2.  Selection of optimum control methods and completion of design;  3.  Procurement, installation and operation of selected control measures;  4.  Testing and acceptance or modification/redesign of controls.  All proposed control measures shall be approved for each particular use by a competent industrial hygienist or other technically qualified person.      Step 3:  Abatement shall have been completed by the implementation of feasible engineering and/or administrative controls upon verification of their effectiveness in achieving compliance.  Feasible engineering and/or administrative controls could include, but the employer is not bound by or limited to, the following:    LOADER  1.  Equip the screen and conveyor areas with local exhaust ventilation.  2.  Move the operator controls into the booth or enclose the operator controls area on the wall of the bay.  3.  Add a supplied air source to the booth and to the operator controls area.  4.  Enclose processes and machinery to isolate them from the loader(s).  5.  Rotate the employees in and out of hazardous job duties to limit their exposures below the PEL for an 8-hour TWA.   6.  Any combination of the above.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.  a.  At the work site, employees used a dust suppression system, DustPro, to spray sand as it was being loaded into tankers for delivery to well sites.  The employer had not adequately trained employees about the chemicals used in the DustPro system before the employees used it, which included (but was not limited to) propylene glycol and alkoxylated alcohols.
