29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) In the Workshop - On or about October 8, 2015, the employer had not developed a written hazard communication program which described how the criteria specified in paragraphs (f) Labels, (g) [Material] Safety Data Sheets, and (h) Training was to be met for employees using chemicals such as but not limited to Ace Lacquer Thinner, Metal Bluing, HoCut 767 B Metalworking Fluid, Carbon Monoxide, Hexavalent Chromium, and Respirable Dust (welding fumes, grinding dust, and PNOR, Particulates Not Otherwise Regulated) at the time of their assignment to the workshop, fabricating metal cutting dies. No abatement certification or documentation required.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: a) In the Workshop - On or about October 8, 2015, the employer had not conducted training on the revised HCS 2012 shipping container labels, the hazard pictograms, and safety data sheet organization for the workplace hazardous chemicals, such as but not limited to Ace Lacquer Thinner, Metal Bluing, HoCut 767 B Metalworking Fluid, Carbon Monoxide, Hexavalent Chromium, and Respirable Dust (welding fumes, grinding dust, and PNOR, Particulates Not Otherwise Regulated) so that the employees could find and apply the [M]SDS hazard information. No abatement certification or documentation required.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: a) In the Workshop - On or about October 8, 2015, employees, fabricating molded cutting dies, were voluntarily using NIOSH-approved N95 2-strap dust masks as respiratory protection against respirable dust (welding fumes, grinding dust, and PNOR, Particulates Not Otherwise Regulated) without being trained on the contents of 29 CFR Part 1910.134 Appendix D. No abatement certification or documentation required.
