Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to paper dust explosions, deflagrations, and fire hazards due to deficient design and/or implementation of preventive and/or protective measures in its dust processing system and related equipment, such as the following:          a. Shred Room  On or about October 8, 2015, employees operating and working within proximity of an industrial shredder/bailer which was serviced by a dust collector system were exposed to explosion hazards due to the design, construction, location, and maintenance of the dust collector system that collected explosive paper dust and was located inside the building without effective protection for workers from risks of fire, explosion, and pressure.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition:        a. Shred Room - On or about October 8, 2015, employees operating and working within the proximity of two industrial shredder/bailers were exposed to fire hazards due to a dust collector system that collected explosive paper dust only being connected to one of the shredder/bailers allowing fugitive dust from the second shredder to accumulate on elevated surfaces throughout the area.

Parts of electric equipment that in ordinary operation produce arcs, sparks, flames, or molten metal were not enclosed or separated and isolated from all combustible material:    a. Shred Room - Employees were not protected from fire hazards due to several pieces of electrical equipment, which had excessive combustible dust accumulation, contained openings in which the dust was able to enter areas that contained live parts.
