29 CFR 1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns were not protected by protective helmets:    At the new residential construction site, employees walking and working below workers above them were exposed to the hazard of falling tools and/or materials and were not protected by the use of hard hats.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6-feet or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of '1926.502(k) developed and implemented.      At the new residential construction site, employees installing decking materials without fall protection were exposed to falling more than 18-feet to the lower level.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:       At the new residential construction site, employees using circular saws were not protected from eye injuries by wearing protective eyewear.    Toribio Ibarra was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 588019, citation number 1, item number 1 and was affirmed as a final order on October 01, 2012, with respect to a workplace located at 6712 Bakersfield Street, Plano, Texas 75074.
