OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while working along active roadways: a) Groll's Disposal, Inc., - On or about 10/5/15, employees who were exposed to struck-by hazards from motor vehicle traffic while conducting waste/refuse collection activities along roadways during periods of darkness and reduced visibility were not provided with and required to wear Class 3 and Class E high visibility apparel along with high visibility headwear.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: A.) Groll's Disposal, Inc. - On or about 10/13/15, and at times prior thereto, a lockout/tagout program consisting of written procedures, employee training, and periodic inspections was not developed, documented, and implemented for vehicle maintenance and servicing operations. Employees were performing servicing and maintenance work on trucks including, but not limited to, garbage trucks and roll off container trucks.
