29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:      a) Work site - On or about October 19, 2015 and at times prior thereto, employees were working in an unprotected trench with a 5-6' spoil pile directly on the edge of the excavation with an employee underneath.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):      a) Work site - On or about October 19, 2015 and at times prior thereto, employees were installing a water line in a trench with vertical walls and having no protective system in place.  At the location of work the trench measured approximately 7' in depth and it was 30' in length.      The Drilling Technologies, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 962433, citation number 1, item number 2 and was affirmed as a final order on April 28, 2014, with respect to a workplace located at Route 9 & Route 20 at Route 150 Schodack Landing, NY 12156.
