29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Construction Site - 1401 Mount Rose Ave, York, PA: the employer had not developed and or implemented a Hazard Communication Program for employee(s) engaged in tuckpointing operations using such products as, but not limited to, Portland Cement, Sand and Coloring Agents on or about October 9, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)        a) Construction Site - 1401 Mount Rose Ave, York, PA: On or about October 9, 2015 an employee was observed preforming masonry mortar joint repair from a welded tubular frame scaffold that was not fully planked between the front uprights and the rear uprights, thereby exposing employees to fall hazards.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

Supported scaffold was erected on soft soil.     a) Construction Site - 1401 Mount Rose Ave, York, PA: On or about October 9, 2015 an employee was observed preforming masonry mortar joint repair from a welded tubular frame scaffold that was erected on soft bedding soil and grass without the use of base plates and mud sills.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.
