29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a) Metal Service of Temple, Inc., 4700 North 5th Street Highway, Temple, Pennsylvania - Employees performed servicing and maintenance activities, such as replacing parts and tool and die changes, on machinery and equipment, including, but not limited to, the Murata Wiedemann Centrum 2500 CNC turret punch, the 90-ton Cincinnati hydraulic press brake, the Chicago Dreis & Krump mechanical press brake, and the Amada RG-50 hydraulic press brake, and the employer did not develop and implement an energy control program, consisting of machine specific energy control procedures, group lockout/tagout, testing and positioning procedures, periodic inspections, and employee training, exposing employees to hazards, including but not limited to, getting caught-in and struck-by moving machine parts, on or about October 22, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees from hazards created by a moving table:  (a) Shop - One of the safety mats for protecting the working envelope of the moving table on the Murata Wiedemann Centrum 2500 CNC turret punch, which would stop the Murata Wiedemann Centrum 2500 CNC turret punch if an employee stepped onto the mat, no longer worked.  The employer removed this mat but had not yet installed the new replacement safety mat or implemented another equivalent protective method, and employees continued to run the turret, exposing employees to the hazard of getting struck-by the moving table, on or about October 22, 2015.  Abatement certification required within 10 days after abatement date. 29 CFR 1910.212(a)(3)(ii): Points of operation of machinery were not guarded to prevent employees from having any part of their body in the danger zones during operating cycles:  (a) Shop - Employees used a foot pedal to operate the Cincinnati 90-ton hydraulic press brake, serial number 42893, to bend work pieces, some of which required the employees to get to within 4 inches of the point of operation, and the press brake did not have point of operation guarding, exposing employees to the hazard of getting caught in the point of operation, on or about October 12, 2015.  (b) Shop - Employees bent some long work pieces on the Cincinnati 90-ton hydraulic press brake, serial number 42893, that required the press operator and a helper to hold.  The press had one foot pedal, which the press operator used to cycle the press, but the helper had no foot pedal and no other protection from the point of operation for this work, exposing the helper to the hazard of getting caught in the point of operation, on or about October 12, 2015.  (c) Shop - Employees used a foot pedal to operate the Chicago Dreis & Krump 90-ton mechanical press brake, serial number L2804, to flatten hems on pieces of expanded metal, and the press brake did not have point of operation guarding, exposing employees to the hazard of getting caught in the point of operation, on or about October 12, 2015.  (d) Shop - Employees used a foot pedal to operate the Amada RG-50 hydraulic press brake, serial number 5058987, to bend work pieces, some of which required the employees to get to within 4 inches of the point of operation, and the press brake did not have point of operation guarding, exposing employees to the hazard of getting caught in the point of operation, on or about October 22, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
