29 CFR 1926.501(b)(13): When another provision in 29 CFR 1926.501(b) did not provide for an alternative fall protection measure; and, the employer could not demonstrate that it was infeasible or creates a greater hazard to use guardrail systems, safety net systems, or personal fall arrest systems these systems: Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrails system, safety net systems or personal fall arrest systems:  a) This violation occurred on or about, October 17, 2015, at a workplace located at 6604 Old Gate Road, Plano, Texas; where at least one (1) employee, who was working from a second-story breezeway bridge with an unprotected edge more than 6-feet above the lower level, was not protected from falling to the lower level

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with one stair-rail system along each unprotected side or edge:  a) This violation occurred on or about October 17, 2015, at a workplace located at 6604 Old Gate Road, Plano, Texas; where employees used the main stairway in the house to travel between the first and second floors.  The staircase, which had more than four (4) risers, had two unprotected edges which exposed employees to the hazard of falling to the lower level.
