29 CFR 1915.1001(k)(3)(i): Before work in areas containing ACM and PACM was begun, the employer did not identify the presence, location, and quantity of ACM, and/or PACM, as required by 29 CFR 1915.1001(k)(1). a) Norfolk International Terminal, Vessel: S.S. Cape May, Norfolk, VA 23517: On or before October 1, 2015, the employer did not identify the presence, location and quantity of asbestos-containing materials prior to employees performing work in the engine room and other areas of the vessel where the employer had identified presumed asbestos-containing thermal system insulation, exposing employees to potential health hazards of inhalation of asbestos. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: a) Norfolk International Terminal, Vessel: S.S. Cape May, Norfolk, VA 23517: On or before November 4, 2015, the employer did not provide employees with the information in Appendix D to 29 CFR 1910.134, where employees were provided and permitted to wear 3M 8200 N95 respirators. No abatement documentation or certification is required.
