29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    In the fabrication area of the rigging building, the employer failed to provide a written hearing conservation program exposing employees to noise hazards. employee operating fabrication machines (saw, press) operator was exposed to continuous noise at 71.9% of the permissible daily noise exposure (8-hour Time Weighted Average sound level of 85 dBA) during the 420 minute sampling period.  For a full eight hour work shift this exposure is equivalent to an average sound level of 87.6 dBA.  Exposure calculations include a zero increment for the 60 minutes not sampled.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:        Paint Booth: employees spraying enamel, primer, clear and top coats in the paint booth were exposed to 1,6-hexamethylene diisocyanate at concentrations of 0.627 mg/m3 calculated as an 8-hour time weighted average, approximately 17.9 times the NIOSH REL of 0.035 mg/m3 and the employer did not conduct any air sampling to determine the exposure.  The employees were exposed to this substance when spraying a 3 part mixture containing, but not limited to, Axalta Coating Systems, primer, coating, and clear coat.

29 CFR 1910.134(d)(3)(i): The employer did not provide a respirator that was adequate to protect the health of the employee under routine and reasonably foreseeable emergency situations:    Paint Booth: employees were exposed to 1,6-hexamethylene diisocyanate homopolymer at concentrations of 0.627 mg/m3 calculated as an 8-hour time weighted average while wearing  air purifying half facepiece respirators as required by the employer.  This was 17.9 times the NIOSH REL. The appropriate respirator for employees routinely exposed to 1,6-hexamethylene diisocyanate homopolymer was a supplied-air respirator.
