29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) On or about 11/17/15 on a jobsite located in front of house at 108 Hertel Ave., Buffalo, NY: An employee exited a 5 ft. 10 in. deep trench by hoisting himself up onto the sidewalk at the south end of the trench. No stairway, ladder, ramp, or other safe means of egress was provided. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 11/17/15 on a jobsite located in front of house at 108 Hertel Ave., Buffalo,NY: An employee was in a trench using a shovel to move some dirt away from a water line that was next to a sewer line that the company was planning to replace. The total length of the trench was 6 ft. 7 in. The north end of the excavation was a narrow trench that was approx. 1 ft. 8 in. long x 2 ft. 4 in. wide x 5 ft. 10 in. deep. The south end of the excavation was approx. 4 ft. 11 in. long x 3 ft. 8 in. wide x 5 ft. 10 in. deep. All sides of the trench were vertical. No protective system was provided to protect the employee from a cave-in hazard. NO ABATEMENT CERTIFICATION REQUIRED
