OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and/or explosion hazards:     (a)CCM Welding, Repair & Fabrication, LLC @ 100 Caspian Ave., Volga, SD 57071:  On or about November 5, 2015, the exposing employer did not ensure employees were protected from fire/explosion hazards as a result of working on top of a tank containing a flammable atmosphere. The exposing employer did not identify flammability levels through the use of atmospheric direct reading instrumentation during an initial assessment or continuous monitoring to ensure the material within the tank would not produce flammable vapors. The condition exposed employees to fire/explosion hazards.    Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to develop and implement specific procedural elements to control explosions in accordance with the National Fire Protection Association (NFPA) 51B-2009 publication, "Standard for Fire Prevention during Welding, Cutting and Other Hot Work." Section 4.2.2 The PAI (Permit Authorizing Individual) shall determine site-specific flammable materials, hazardous processes, or other potential fire hazards that are present or likely to be present in the work location. 29 CFR 1926.20(b)(2):  The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):     (a)CCM Welding, Repair & Fabrication, LLC @ 100 Caspian Ave., Volga, SD 57071: On or about November 5, 2015, the employer had not fully implemented formal safety programs and training to ensure that safety hazards were identified and addressed.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.502(d)(15): Anchorages used for attachment for personal fall arrest equipment were not capable of supporting at least 5,000 pounds per employee:       (a)CCM Welding Repair & Fabrication, LLC @ 100 Caspian Ave., Volga, SD 57071: On or about November 5, 2015, the exposing employer did not ensure employees were protected from fall hazards. The employer did not ensure employees were using an anchorage system that would be able to support 5,000 lbs, in that, employees were attached to the guard railing of the catwalk that spanned the distance between two tanks, and was not secured to the tanks. The condition exposed employees to a fall hazard in excess of 6 feet.

In multistory buildings, at least one fire extinguisher shall be located adjacent to stairway:    (a)CCM Welding Repair & Fabrication, LLC @ 100 Caspian Ave., Volga, SD 57071: On or about November 5, 2015, the exposing employer did not ensure employees were protected from fire hazards during welding operations on T849. The employer did not have a fire extinguisher rated not less than 2A in the work area. The fire extinguisher for the project was at ground level. This condition exposed employees to a fire hazard during welding operations.

29 CFR 1926.1425(c)(3): The materials must be rigged by a qualified rigger.      (a)CCM Welding Repair & Fabrication, LLC @ 100 Caspian Ave.,  Volga, SD 57071: On or about November 5th, 2015, the exposing employer did not ensure employees were qualified riggers during hoisting activities involving the catwalk installation. The employer did not ensure employees possessed a recognized degree, certificate or professional standing or had extensive knowledge and expertise and demonstrated the ability to solve problems related to rigging loads. Employees were involved in rigging a catwalk without receiving the training to be considered qualified riggers. The condition exposed employees to struck-by hazards associated with improperly rigging a load.
