29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Maverick Pump Services, LLC at 23rd Ave. and 2nd Street, Greeley, CO 80631: On or before November 4, 2015, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions specific to this work environment, and the actions necessary to eliminate, control, and mitigate the associated hazards. The unsafe conditions included: 1) The volume of traffic; 2) The temporary lane closures of one lane of a two lane road using flaggers; 3) The movement of personnel, equipment, materials, and supplies in the work zone; 4) The duration of work including working at night; and 5) The fall hazards associated with open manholes. b) Maverick Pump Services, LLC at 23rd Ave. and 2nd Street, Greeley, CO 80631: On or before November 4, 2015, the employer did not instruct each employee on the exposure to the biological hazards associated with sewer work. Conditions exposed employees to the hazard of being struck-by motor vehicles, fall hazards, and biological hazards. Abatement note: The instruction failed to include the movement of the employees, equipment, and materials in the work zone; the duration of work; the traffic control plan; and the communication with the flaggers.

29 CFR 1926.56(a): While work was in progress, construction areas, ramps, runways, corridors, offices, shops or storage areas were not lighted to the minimum illumination intensities as listed in Table D-3 of 29 CFR 1926.56: a) Maverick Pump Services, LLC at 23rd Ave. and 2nd Street, Greeley, CO 80631: On or before November 4, 2015, while work was in progress, the construction area was not lighted to the minimum illumination intensities as listed in Table D-3 of 29 CFR 1926.56. The sewer bypass company was connecting pipes and a pump to the existing sewer line that was accessed through the manhole located at this intersection. The sunset was at 4:52 pm, and the crew worked until at least 9:00 pm. The work area was not provided with at least 5 foot candles of illumination. Condition exposed employees to the hazard of being struck by motor vehicles, resulting in serious bodily injury.

29 CFR 1926.251(a)(1): Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it was safe. Defective rigging was not removed from service: a) Maverick Pump Services, LLC at 23rd Ave. and 2nd Street, Greeley, CO 80631: On or before November 10, 2015, the employer did not inspect the rigging, and failed to remove damaged rigging from service. The The employer used a John Deere Mini Excavator Model 50 with this rigging to hoist the pump, the fuser, and piping from trailers. The 3 inch wide polyester rigging, manufactured by Bishop Lifting Products, Inc. model 03EE2PX-111, serial number 311178, was damaged beyond its warning markers. Condition exposed employees to the hazard of being struck by the swinging and falling materials and equipment.

The employer opened the manholes covers to connect sewer bypass piping and a pump to the existing sewer line. Condition exposed employees to fall hazards of up to 10 feet, and to confined space hazards, during this work.
