29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a) East Chase Apartments Bldg #7 at Berryhill Road, Montgomery AL; On or about November 17, 2015 the employer exposed employees to worksite hazards in that the employer failed to instruct his employees in the recognition and avoidance of unsafe conditions applicable to their work environment to control or eliminate any hazards or exposure to illness or injury. Employees were allowed to work at height without first being trained in the requirements of fall protection such as body harness and lanyard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a)  East Chase Apartments Bldg #7 at Berryhill Road, Montgomery AL; On or about November 17, 2015 the employer exposed his employees to fall hazards in that employees were allowed to work on a stair case landing of an apartment building that had an unprotected edge exposing employees to a 15 foot fall to the next level.
