29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    East side of roadway; On or about November 24, 2015, employees were exposed to struck-by hazards while in an excavation greater than 5 feet in depth by 6 feet in width by 8 feet in length, when installing utilities in an excavation with a spoil pile located less than 2 feet from the excavation wall.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    East side of roadway; On or about November 24, 2015, employees were exposed to cave-in hazards while installing utilities in an excavation greater than 5 feet in depth by 8 feet in length by 6 feet in width that was not inspected by a competent person and lacked cave-in protection, a ladder used for access and egress, and had spoil pile within 2 feet of the excavation wall.
