29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   At the residential construction site located at 11310 166th Terrace in Overland Park, Kansas:  Employees engaged in roofing activities were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals.  Employees were exposed in that the employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.  Hazardous chemicals used at the site included but were not limited to gasoline.

Employees were exposed in that a copy of the required safety data sheet for gasoline was not maintained at the residential construction site.

Employees were exposed in that they had not been provided with training or information regarding the hazardous chemicals with which they work.  Hazardous chemicals such as gasoline were used at the residential construction site.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  At the residential construction site located at 11310 166th Terrace in Overland Park, Kansas:  Employees engaged in residential roofing/ framing activities were exposed to fall hazards of approximately 13 feet from the eave of the residence to the ground below while accessing and exiting the roof in that the portable ladder did not extend at least 3 feet above the upper landing and was not secured to the residence/structure.
