On December 3, 2015, employees working in a trench that ranged from 5 feet to 6 feet deep were not protected from a collapse hazard by the use of a protective system.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could have resulted in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions were taken to ensure their safety:  a. On December 3, 2015, the competent person did not remove employees from the trench when there was evidence of cave-in.
