29 CFR 1926.651(i)(1): Where the stability of adjoining buildings, walls, or other structures was endangered by excavation operations, support systems such as shoring, bracing or underpinning was not provided to ensure the stability of such structures for the protection of employees:  (a) On or about December 7, 2015 and at times prior, for the employee of Perreault Construction, Inc. who sustained fatal injuries when he was crushed by an unstable basement wall while installing drain tile in an unprotected excavation around a residential structure located at 5968 19th Street SW in Hazen, North Dakota.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a) On or about December 7, 2015 and at times prior, for the employee of Perreault Construction, Inc. who sustained fatal injuries when he was crushed by an unstable basement wall while installing drain tile in an unprotected excavation around a residential structure located at 5968 19th Street SW in Hazen, North Dakota.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:     (a) On or about December 7, 2015 and at times prior, for the employee of Perreault Construction, Inc. who sustained fatal injuries and was exposed to cave-in hazards while installing drain tile in an excavation approximately seven feet three inches deep with an unprotected vertical wall at a residence located at 5968 19th Street SW in Hazen, North Dakota.
