29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   The employer is failing to protect employees from fall hazards associated with re-roofing an existing residential home where the roof pitch is approximately 10:12 and the ground to eave height is approximately 10 feel 11 inches.  The most recent occurrence of this happened on a job site located at 9209 Hillcrest Dr. LaVista, NE where the employer, his subcontractor and his subcontractors employees were on the roof of an existing residential home without fall protection while re-roofing the house.     Enrique Acosta-Perez Roofing Company was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 314062175, Citation number 1, item number 1 and was affirmed as a final order on December 21, 2011, with respect to a workplace located at 13602 S. 26th Street, Bellevue, NE 68147.    Enrique Acosta-Perez Roofing Company was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 314060054, Citation number 1, item number 1 and was affirmed as a final order on June 27, 2011, with respect to a workplace located at12915 28th Ave, Bellevue, NE 68123.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  The employer is failing to protect employees from fall hazards associated with using a ladder to access and egress from the roof of an existing residential home.  The most recent occurrence of this happened on a job site located at 9209 Hillcrest Dr. LaVista, NE where the employer, his subcontractor and his subcontractors employees were using an unmarked 25 foot fiberglass extension ladder as means of access and egress of the roof of an existing residential home they were re-roofing, without having extended the ladder at least three feet over the upper landing surface.    Enrique Acosta-Perez Roofing Company was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 31406054, Citation number 1, item number 2, and was affirmed as a final order on June 27, 2011, with respect to a workplace located at 12915 28th Ave, Bellevue, NE 68123 .
