29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  On or about December 12, 2015, two workers performing construction work from the elevated Terex Aerial Lift were not wearing safety harnesses, exposing the employee to a fall hazard of approximately 17 feet.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  On or about December 12, 2015, and at times prior thereto, a metal platform supported by a SkyTrak Model # 6036 rough terrain forklift was used to elevate personnel for construction work. Employees were exposed to the hazard of falls and being stuck by equipment.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:   On or about March, December 12, 2105, and at times prior thereto, a metal platform installed on the SkyTrak rough terrain forklift was used to elevate personnel on and off the roof of the commercial property under construction. The forklift was not designed for such use per the manufacturer's operations manual.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.  On or about December 10, 2015, four employees installing insulation along the edge of the roof on the commercial property under construction were not protected from falling over 15 feet.
