29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job sites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):     (a)Port Neal Welding Co., Inc. @ 718 N. Derby Lane, North Sioux City, SD 857049:  On or about December 9, 2015, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Three employees were working on installing an overhead crane within a building while working next to the edge of the roof without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 60 feet to the ground below.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system.     (a)Port Neal Welding Company, Inc. @ 718 N. Derby Lane, North Sioux City, SD 57049:  On or about December 9, 2015, the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system, in that, three employees engaged in the installation of an overhead crane were working on the roof without a fall protection system. This condition exposed three employees to a fall hazard of approximately 60 feet.
