29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.  On or about 17 December 2015 and at times prior thereto, the employer did not provide instruction to employees to recognize and avoid unsafe conditions to include, but not limited to, storage of materials at the edge of a hoistway and material hoisting.

29 CFR 1926.501(c)(1): When employees were exposed to falling objects, the employer did not have each employee did not erect toeboards, screens, canopy structures or barricades to prevent objects from falling from higher levels.  On or about 17 December 2015 and at times prior thereto, the employer did not install toeboards or screens on the second floor temporary balcony, exposing workers at ground level to the hazard of being struck by falling objects.
