29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): (a) DELHAIZE AMERICA DISTRIBUTION CENTER 7, CHEP PALLET SORTING AREA - Employees performed lockout tag out procedures on the Smetco 300 pallet sorting machine in order to service and repair the equipment, and the lockout tag out procedures that had been developed by the employer had not identified all sources of energy, or magnitude of energy that energizes the machine, on or about December 22, 2015. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.303(b)(7)(iv): There were damaged parts that could adversely affect safe operation or mechanical strength of the equipment, such as parts that were broken, bent, cut, or deteriorated by corrosion, chemical action, or overheating: (a) DELHAIZE AMERICA DISTRIBUTION CENTER 7, CHEP PALLET SORTING AREA - Employees performing service and/or repair on the Smetco 300 pallet sorting machine performed lockout tag out at the energy control panel located adjacent to the machine. When the switch located on the outside of the panel became broken and unusable, employees opened the door of the energized 480 volt cabinet and manually rotated the switch to de-energize the machine, thereby exposing the employee to arc blast injuries, on or about December 22, 2015. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

The locks that the employee(s) used for lockout tag out were not standardized, where two of the locks were Blue in color and had a long locking hasp, and two of the locks were steel locks with short locking hasps and labeled "Prinzing", which thereby exposed employees to possible injury, on or about December 22, 2015. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
