OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees accessing the cement mixer hopper. A worker could fall while accessing the mixer or while holding onto the mixer during cleaning where there was no work platform provided.  Back of the Shop:  Workers are exposed to fall hazards while cleaning the mixer hopper when they climb onto a forklift and get on a top of a pouring bucket and then transfer onto either the door of the mixer or the discharge mechanism for the mixer.
