29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: a) First Floor, East Grocery - On or about 12/30/2015, an electrician using a portable electric band saw that was not provided with a continuous ground was not protected from electrical hazard by either an assured equipment grounding conductor program or ground fault circuit interrupters. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) Ground Floor, East Grocery - On or about 12/30/2015, an electrician using a portable electric band saw with the ground pin removed from the saw's attachment plug. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: a) Main Service Entrance, Building #2 Disconnect - On or about 12/30/2015, two electricians were terminating cables in a disconnect enclosure which contained 208 volt/600 amp live parts and did not first either de-energize the line side of the circuit or use appropriate personal protective equipment and procedures for working on or near to energized parts. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
